This Privacy Notice (“Privacy Notice”) sets forth the policies and practices of PROHIT, LLC, a Limited Liability Company formed under the laws of the State of Florida (“PROHIT”), with respect to information, including personally identifiable information and data (“Personal Information” or “Personal Data”), that PROHIT collects, as well as the rights and choices individuals have regarding such Personal Information. This Privacy Notice applies to all Personal Information collected by PROHIT, including through the use of its website at https://prohittraining.com (the “Website”), the PROHIT Mobile App (the “App”), or for any other services provided by PROHIT (collectively, the “Services”).

This Privacy Notice applies to all information collected from or about users 16 and older. For information collected from or about users 15 and younger, please see our Privacy Notice – Minors and Children.

This Privacy Notice is accessible at all times within the PROHIT app (Settings > Privacy) and in our App Store listing. It explains the categories of data we collect, how and why we use it, what we share with service providers or related entities under equivalent or stronger protections, how long we retain data (or the criteria we use), and how you can withdraw consent or request deletion.

I. What Information Do We Collect?

Information You Voluntarily Provide to Us: We collect Personal Information from you when you voluntarily provide it, such as when you contact us, register for access to our Services by creating a user account (an “Account”), whether as a player or a coach, sign up for alerts, or purchase products or services. Personal Information may include, but is not limited to:

To help protect user privacy, we limit access to another user’s contact information. This access may include the other user(s)’ name, unique user ID, profile image, bio, and general location information (city and state).

Your name and Username, along with any descriptive or biographical information you share in your user profile, including your profile picture, will be available to other registered users when you use the Services. Please use caution when deciding how you want to be identified and how many personal details you choose to share when using the Services.

If you submit any Personal Information about other people in connection with any PROHIT Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Notice.

Anything you write in a chat message to another user is not stored in our system. We do not mine user chat messages for information, pull any such information (e.g., if you provide another user’s address), or store it separately. We do not store this data or use it for any purpose, except that we store your chat history as described in this Privacy Notice.

We are not responsible for protecting any information you choose to share through the Services with other users or third parties that are not affiliated with PROHIT. We do not control how other users with access to the Services, including areas not open to the general public, use any content you share, whether publicly or privately. Please exercise discretion when sharing Personal Information with other users.

Information We Collect Automatically: When you interact with the Services, we automatically collect the following information about you:

Most web browsers are set to accept cookies by default. You can usually set your browser to remove or reject browser cookies. Please note that not all tracking will stop even if you delete cookies.

When requesting access to device features (e.g., camera, photos, microphone, contacts, motion, screen recording), we present OS permission prompts with clear purpose descriptions that align with this Privacy Notice. We do not track users for advertising without obtaining the required in-app consent.

Information We Collect from Other Sources: We may receive information from third parties, including advertising and marketing partners, public databases, and social media platforms (including from people with whom you are friends or otherwise connected). If we do so, this Privacy Notice governs how we use that information, regardless of whether such use is independent of or in combination with information you have provided.

Sensitive Personal Information: We do not collect sensitive personal information from you. However, if you elect to submit such information to us, it will be subject to this Privacy Notice.

II. How Do We Use Your Personal Information?

PROHIT may use Personal Information as permitted by law, for the following business purposes:

Marketing push notifications are sent only if you opt in to receiving such notifications. You may change your notification preferences at any time in Settings > Notifications.

Disclosure of Your Personal Information: To the extent permitted by law, all of your Personal Information may be disclosed with the following categories of third parties:

Upon subscription, our email marketing vendors may track the pages you visit on the Website. If you become a customer, information about your transaction may be provided to our email marketing vendors.

Our marketing emails may contain tracking pixels that allow us to analyze their performance. These tracking pixels allow us to see whether and when you open an email, which links you click, and which pages of the Website you visit. This information is not provided to third parties.

At no time is your banking information passed to the Services from any Third Party Vendor. We receive only the information necessary for order fulfillment.

Disclosure of Other Information

In addition to collecting Personal Information, we may collect information that does not identify you and is not associated with your Personal Information. We may also de-identify information so it no longer identifies you.

Analysis of Website/App Performance: We may use such information and combine it with other information to track, for example, the total number of visitors to our Website, the number of visitors to each page of our Website, the number of users and user behavior on the App, and the domain names of our visitors’ Internet service providers. Importantly, no Personal Information is available or used in this process.

Customer Research: To better serve and understand our users’ needs, we may conduct research on our user demographics, interests, and behavior based on the Personal Information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregate data with our affiliates, agents, and business partners. This aggregate information does not identify you personally. PROHIT may also disclose aggregated user statistics to describe our services to current and prospective business partners and to other third parties for other lawful purposes.

Publicly Available Information

When you use certain parts of the Services, the information you share may be visible to other users, depending on the specific service. This includes any information you post or share, such as your name, email address, location, and phone number. Please note that other users can always share any information you provide to them with others, so please exercise discretion.

III. Your Rights Related to Your Personal Information

We provide several ways for you to exercise certain privacy choices regarding your Personal Information that we process. We are committed to respecting your privacy rights under all applicable privacy laws. Some privacy laws require us to provide specific information about individual rights to applicable consumers, which we have set forth in Section IX of this Privacy Notice.

Marketing. You may opt out of receiving marketing-related communications from us going forward by contacting us through the information provided in this Privacy Notice or by using the unsubscribe mechanism in each email. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt out.

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether to allow the collection of information via other tracking technologies by unsubscribing. If you block the use of tracking technologies, some parts of the Services may become inaccessible or fail to function correctly.

Cookies preferences.  To review and update your preferences for most types of cookies (other than those that are necessary) for our Services, click the “Cookie Preferences” link in the footer of the Website.

Location Information. You can choose whether to allow the App to collect and use real-time location data from your device in your device’s privacy settings. If you block the use of location information, some parts of the App may become inaccessible or malfunction.

Deactivation.  You can deactivate your account at any time by contacting us at app@prohittraining.com. However, once your Account is deactivated, you will no longer be able to access any Services that are for registered users only. Please note that even if you request the deactivation of your account, it may take some time to process.

Access, amendment, and deletion. Under applicable privacy laws, you may have the right to request to review, amend, or delete your Personal Information that we hold, or otherwise exercise your rights over it, subject to certain legal limitations and requirements. If you are subject to such a privacy law, you may submit a request to us regarding your Personal Information:

We will process any request in accordance with – and where required by – applicable law with respect to your Personal Information. We will verify your identity before processing your request. Unless prohibited by applicable law, we reserve the right to charge a reasonable fee to cover costs for providing copies of Personal Information that you request.

If you have an Account with us, you may also make certain changes directly through your Account profile page. Please note that changes you make to your Account profile page may not always be reflected immediately.

Although our active systems and databases will reflect updates that have been requested and processed, we may retain all Personal Information for backups, archiving, preventing fraud and abuse, analytics, and satisfying other legal obligations we reasonably believe are applicable.

Please note that we may need to retain certain information for recordkeeping and to complete any transactions you initiated before you requested a change or deletion. There may also be residual information in our databases and other records that will not be removed. We may not always be able to address your request fully, for example, if doing so would impact the duty of confidentiality we owe to others, or if we are legally entitled to handle the request differently.

IV. Changes to this Privacy Notice

We may periodically update this Privacy Notice. Please reference the “LAST UPDATED” legend at the top of this page to see when this Privacy Notice was last revised. If any changes to this Privacy Notice materially impact the use of Personal Information such that new or additional notice or consent is required, we will notify you before any such changes. All other changes to this Privacy Notice will become effective when we post the revised Privacy Notice on the Website or the App.

V. Children and Minors; Identity Verification

Children and Minors

Children under the age of sixteen (16) may use our Services only with full, verified parental consent. The collection and processing of Personal Information from users under 16, as well as the process for obtaining parental consent, are governed by our Privacy Notice – Minors and Children.

Identity Verification

We are committed to preventing anyone under the established legal age from using our Services without parental consent and to providing a safe, positive experience. We will provide access to our Services only after you have provided adequate proof of your identity, that you are of legal age for the Services you wish to use, and that you understand that providing false information as part of such verification may constitute a violation of the law.

Before you can use our Services, we will verify your age and identity through a non-affiliated third party. The process prioritizes keeping all Personal Information from being shared or accessed by third parties, including us.

If we are unable to verify your age and/or identity through their verification service, you will be asked to upload a copy of your government-issued ID so we can manually verify your date of birth. Photo IDs are uploaded to our third-party partner’s secure database, and we process the result that they provide – we do not receive the image or contents of your ID, and it is not stored in our servers or database.

We reserve the right to prohibit the use of our Services by any individual who refuses to provide adequate proof of age and identity, provides proof of age or identity that we reasonably deem false or misleading, or is determined by PROHIT to be of unacceptable character or behavior for continued use of the Services.

VI. Third Party Privacy Practices

Our Services may contain links to third-party websites or apps. If you click on one of these links, please note that each one will have its own Privacy Notice. We do not control these websites/apps and are not responsible for those policies. When you leave the Website or the App, we encourage you to read the Privacy Notice of every website you visit.

We are not responsible for the privacy and data security practices of other organizations, such as Facebook, Instagram, Apple, Google, Microsoft, X or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer. Please review their privacy policies and consider customizing your browser or mobile settings to limit the disclosure of certain information, such as location data.

Any Personal Information that you provide through these third-party websites, mobile applications, or social platforms will be subject to the Privacy Notice of its operator, and not this Privacy Notice.

VII. Do Not Track Signals

We do not monitor or follow “Do Not Track” (DNT) signals because there is no standard interpretation or practice for DNT signals. Therefore, we handle all user information consistent with this Privacy Notice.

VIII. Miscellaneous Terms and Conditions

Other Terms and Policies

This Privacy Notice is to be read in conjunction with the Website’s Terms of Use and Disclaimer, the App’s Terms of Use, and all applicable rules and terms related to your use of the Services and maintaining an Account. Your access to and use of the Services may also be subject to any separate agreements or terms and conditions you have signed or agreed to with PROHIT. Please refer to those agreements as needed.

Reservation of Rights

Regardless of any other provision in this Privacy Notice, we reserve the right to disclose any personally identifiable or non-personally identifiable information about you to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our Website, or other users; or (d) protect, in an emergency, the health and safety of our customers or the general public. This includes exchanging information with third parties and organizations to reduce credit risk and protect against fraud.

Security of Personal Information

We use standard physical, technical, and administrative measures designed to reduce the risk of loss, misuse, unauthorized access, disclosure, or modification of your Personal Information. Unfortunately, no system or network can be guaranteed to be 100% secure.

The safety and security of your Personal Information also depends on you. Where we have given you (or you have chosen) a password to access certain parts of our Services, you are responsible for keeping it confidential. Do not share your password with anyone. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us at app@prohittraining.com.

We will retain your Personal Information only for the period necessary to fulfill the purposes outlined in this Privacy Notice, unless a longer retention period is required or permitted for legal, auditing, or compliance purposes.

Please note that your Username, Profile Information, and Profile Picture will be made available to other users and the public when you create an Account and add personal details. Please exercise discretion when using the Services to post personal information.

Account Deletion

Users can delete their account directly in the app by going to Settings > Account > Delete Account. Deletion removes profile information and user-generated content from our production systems, subject to lawful retention obligations described herein.

IX. Additional Information for Certain Jurisdictions

Residents of certain countries or U.S. states have additional rights under applicable privacy laws, as described in this section.

A. Residents of the European Economic Area or the United Kingdom

The GDPR and UK data protection laws (where applicable) give data subjects the following rights regarding their personal information:

Right of access: You have the right to know whether or not personal information concerning you is being processed and, if so, to request access to the personal information. You have the right to request the purposes of the processing, the categories of personal information concerned, and the recipients or categories of recipient to whom the personal information has been or will be disclosed. You have the right to obtain a copy of the personal information undergoing processing. For any additional copies you request, we may charge a reasonable fee based on administrative costs.

Right to rectify and complete personal information: You can request the correction of inaccurate data and the completion of incomplete data. We will inform the relevant third parties to whom we have transferred your data of the rectification and completion, if required by law.

Right to erasure (right to be forgotten): You have the right to request that we erase personal information in limited circumstances where:

We are not required to comply with your request to erase personal information if processing it is necessary to comply with a legal obligation, or to establish, exercise, or defend legal claims.

Right to restriction of processing: You have the right to restrict the processing of your personal information. In this case, the relevant data will be marked and processed only by us for specific purposes. This right may be exercised, subject to certain limitations, when: (i) the accuracy of your personal information is contested; (ii) the processing is unlawful but you do not want the personal information erased; (iii) it is no longer needed for the purposes for which it was collected, but you still need it to establish, exercise, or defend legal claims; or (iv) you have exercised the right to object and verification of overriding grounds is pending.

Right to data portability: You have the right to receive a copy of the personal information concerning you that you have provided to us in a structured, commonly used, machine-readable format. You have the right to transmit such data to another entity without hindrance from us, but in each case only where the processing is (a) based on your consent or on the performance of a contract with you, and (b) also carried out by automated means.

Right to object: You have the right to object at any time to any processing of your personal information that is being processed based on our legitimate interests. You may exercise this right without incurring any costs. If you raise an objection, we have an opportunity to demonstrate that we have compelling legitimate interests that override your rights and freedoms. The right to object does not exist, in particular, if the processing of your personal information is necessary to take steps prior to entering into a contract or to perform a contract already concluded.

Right to object to our use of your personal information for direct marketing: You can request that we change the manner in which we contact you for marketing purposes. You can request that we not transfer your personal information to unaffiliated third parties for direct marketing or any other purpose.

Right to withdraw consent: If you have given us your consent for the processing of your personal information, you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

Right to lodge a complaint with your local supervisory authority: You have a right to lodge a complaint with your local supervisory authority if you have concerns about how we are processing your personal information. We ask that you please attempt to resolve any issue with us first, although you have the right to contact your supervisory authority at any time.

PLEASE NOTE: Any content in a chat message between users is stored in the chat message itself, not in your user profile or as a separate data category. This may include certain categories of information listed above as “Not Collected.” For example, if you chat with another user about your education history, we do not store this data separately or use it for any purpose. We do not mine user chat messages for information, share their content with third parties, or use them for any purpose other than facilitating a chat service between users. Therefore, we have listed certain categories of data as Not Collected because they are not intentionally collected by us or used for business purposes.

In addition, we may disclose any of the categories of personal information we collect about you to other third parties as directed by or consented to by you, or where necessary to fulfill your specific requests.

Sales and sharing. The CCPA defines a “sale” as disclosing or making available personal information to a third party in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising. While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or “share” (as defined by the CCPA): (i) identifiers, usage data, customer records, commercial information, and profiles with our affiliates and subsidiary companies (e.g., to improve or enhance their own records and for other purposes); (ii) identifiers, customer records, and commercial information (related to property sales and transactions) with partners and third-party businesses, who may use or process the information for their own commercial purposes; and (iii) identifiers, usage data, and commercial information to ad networks, social media platforms, and data analytics providers (e.g., to improve and measure our ad and marketing campaigns).

Submitting CCPA Requests.  California residents may exercise their CCPA privacy rights to know/access, delete, correct, and limit use/disclosure of sensitive personal information by submitting a verifiable request to us via:

We will respond to verified requests received from California residents as required by law. When you submit a request to know or to delete, we will verify your identity by comparing the information you provide with our records.  You must provide all requested information so that we can process and verify your request.  In some cases, we may request additional information to verify or process your request. If we are unable to verify a request, we will notify the requester.  Authorized agents may initiate a request on behalf of another individual by contacting us via email or phone. They must provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the agent’s authority.

Requests to Opt Out. Our Website and App respond to global privacy control—or “GPC”—signals. If we detect that your browser is communicating a GPC signal, we will treat it as a request to opt out of sales and sharing (i.e., via cookies and tracking tools) on our Website for that browser and device. Note that if you return to our Website from a different device or use a different browser on the same device, you will need to opt out (or set GPC for) that browser and device as well. (You can also manage your preferences for targeting and other cookies on our Website through the “Cookie Settings” link in the footer of each Website.)

Incentives. We may offer certain programs or offerings that are considered “financial incentives” under the CCPA. We will provide notice of the material terms of these incentives and obtain consent from individuals before including them in these incentive programs. You can opt out of such programs at any time through the opt-out mechanism provided in the program information.

Rights Under California’s Shine the Light Law. California residents may request from businesses with whom they have an established business relationship: (1) a list of categories of personal information, such as name, address, e-mail address, and the type of services provided to the customer, that a business has disclosed to third parties during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (2) the names and addresses of all such third parties. To request this information, please contact us via the “Contact Us” section above. We will respond to such requests within 30 days of receipt.
